All Phase Guttering Warranty Agreement
Exclusions
Warranty excludes all acts of nature such as high winds, hail, ice, snow, flood or other forces that All Phase cannot control - also all negligence on the part of the purchaser, whether accidental or not. All Phase does not warranty water dripping between gutter and fascia. All Phase does not warranty splitting of existing 1x2 wood fascia trim.
Any changes made from agreement after installation begins will include a service charge plus extra material and labor. Unless specified on this agreement, prices do not include leaf screen or any fascia/eaves area wood repairs
In addition, All Phase Guttering is not responsible for any wiring that needs removed from old guttering for gutter work to be completed. If exterior lighting wires are running through downspouts, All Phase will cut the wires at the base of the downspout, remove the light if attached to the gutter - but will not be responsible for reinstalling the wire and lighting. Homeowner will be responsible for reconnecting any lighting that is disconnected for the gutter installation.
Payments & Installation Process
Seller shall retain 10% of the total agreement price or total cost of any custom fabricated or specially ordered materials if the purchaser cancels agreement before installation. Residential/commercial pricing is good for 30 days. Service price may expire after 10 days. Total balance of purchase price is due upon completion. Purchaser hereby acknowledges funds will be paid in full and no portion withheld if minor warranty work is required. The warranty is voided if payment is not received within 10 days of job completion.
Purchaser will and does hereby agree to pay any and all attorney fees and court costs as a result of non-payment. Purchaser agrees that this agreement is signed without any reliance upon any representations or promises of the company or its agent except as is specifically written on the face of the agreement, and that no such promises or representations have been offered as an inducement for signing. It being the intent and agreement of the parties that this agreement constitutes the entire agreement and understanding of the parties.
Installations are scheduled upon acceptance of signed agreement. No order shall be installed without prior notification of the customer. All Phase reserves the right to file material and labor liens on the property as a result of non payment of agreed terms, including but not limited to the cost of filing, preparing, and releasing mechanic’s lien.
Gutter Protection
Almost all gutter protection products on the market today are designed to keep leaves, sticks, and general debris out of your gutters thus allowing water to flow freely through the gutter system to the downspout and away from your home. Gutter protection products are not designed to keep debris off the top of the gutter protection system. They are designed, however, to keep water flowing through the guttering system and away from your home. In most cases the rain and wind will aid in the removal of leaves and small sticks from the top of gutter screens.
Some areas, such as the inside valleys that have water valley deflectors, and flat roofs may need to be occasionally brushed off due to normal conditions and storms that bring down tree debris. Also, heavier than average rain storms may cause the gutters to experience short term overflow during some strong storms. This is to be expected from time to time.
It is imperative that homeowners maintain the gutter protection system either through their lawn care contractor or brush off these areas themselves just as you would do with the debris that gathers on the roof shingles or even debris that gathers in your yard.
